These Terms of Service ("Terms") govern your use of the LumifyHQ platform, operated by LUMIFY Labs Pvt Ltd ("we", "our", "us"). By accessing or using our service, you agree to be bound by these Terms.
You must be at least 18 years old and authorized to enter into a binding contract to use our service. You are responsible for maintaining the security of your account credentials and for all activities under your account.

LumifyHQ provides a digital loyalty program platform including stamp card management, customer engagement tools, analytics, and notification delivery via WhatsApp, SMS, and email. Features and availability may vary based on your subscription plan.
We aim for 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated at least 24 hours in advance. We are not liable for temporary service interruptions caused by third-party providers (Supabase, Twilio, Vercel) or force majeure events.
New accounts receive a 14-day free trial. No payment method is required. At the end of the trial, you must subscribe to a paid plan to continue using the service. Trial accounts have access to all features with usage limits as defined in our pricing page.
You retain full ownership of all customer data you collect and process through LumifyHQ. We process this data solely to provide our services and will not share, sell, or use your data for any purpose other than delivering the platform. You may export or delete your data at any time.
LumifyHQ, including its software, branding, logos, and documentation, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the service for your business purposes. You may not reverse-engineer, copy, or redistribute our software.
LumifyHQ is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, secure, or meet your specific requirements.
To the maximum extent permitted by law, LUMIFY Labs Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the service.
Our total liability for any claim arising out of these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify and hold LUMIFY Labs Pvt Ltd harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate this agreement:
Upon termination, your data will be retained for 30 days and then permanently deleted. Export your data before cancellation.
These Terms are governed by the laws of India. Any disputes shall be resolved through arbitration in Bengaluru, Karnataka, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator appointed by mutual agreement. The language of arbitration shall be English.
We may modify these Terms at any time. Material changes will be communicated via email and in-app notification at least 14 days before they take effect. Your continued use of the service after changes constitutes acceptance of the updated Terms.
